These Terms and Conditions (“Terms”) govern your use of the services provided by Yan's Gourmet (“we,” “us,” or “our”), including but not limited to in-person dining, takeout, delivery orders (whether placed directly with us or through third-party platforms), reservations, phone orders, our website (if applicable), and any related services (collectively, the “Services”).
By placing an order, making a reservation, entering our premises, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Use of Services
• You must be at least 18 years of age or have the legal capacity to enter into contracts in your jurisdiction to place orders or make reservations.
• You agree to provide accurate, current, and complete information when placing orders or making reservations.
• All orders are subject to availability. We reserve the right to refuse, cancel, or limit any order for any reason, including but not limited to suspected fraud, errors in pricing, unavailability of items, or violation of these Terms.
2. Pricing & Payment
• All prices are in USD and are subject to change without notice.
• Prices displayed do not include applicable sales tax, delivery fees, service charges, gratuity (where applicable), or third-party platform fees.
• Payment is due at the time of ordering. We accept major credit/debit cards and other payment methods as indicated at the time of checkout.
• By providing payment information, you represent that you are authorized to use the payment method and authorize us (and our payment processor) to charge the total amount to your chosen payment method.
• All charges are final and non-refundable except as expressly provided in these Terms or required by law.
3. Order Fulfillment & Delivery
• Takeout & Dine-in: Orders are prepared as quickly as possible. Wait times are estimates only.
• Delivery:
• Delivery times are estimates only and not guaranteed.
• We or our third-party delivery partners are not responsible for delays caused by traffic, weather, address issues, or other circumstances beyond our reasonable control.
• You must provide a correct and complete delivery address. We are not responsible for orders delivered to an incorrect address provided by you.
• You must be present or arrange for someone to receive the order at the delivery address. We are not responsible for orders left unattended if no one is available to receive them.
4. Cancellations, Refunds & Modifications
• Once an order is placed and preparation has begun, it generally cannot be canceled or modified.
• We may, in our sole discretion, allow cancellations or modifications in limited circumstances.
• Refunds are issued only in cases of significant error on our part (e.g., wrong item prepared), non-delivery (when delivery was promised), or as required by law.
• No refunds will be given for change of mind, incorrect orders due to customer error, or dissatisfaction with taste/subjective quality (food quality is subjective).
• Third-party platform orders are subject to the cancellation and refund policies of that platform.
5. Food Allergies & Special Requests
• We take food safety seriously and make reasonable efforts to accommodate dietary requests.
• However, we cannot guarantee that any item is completely free from allergens due to shared preparation areas, equipment, and ingredients.
• It is your responsibility to inform us of any serious allergies and to verify ingredients when placing your order.
• We assume no liability for any allergic reactions or other adverse effects related to food consumption.
6. Intellectual Property
All content on our website (if any), menus, logos, and other materials are owned by Yan's Gourmet or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
7. Limitation of Liability To the fullest extent permitted by law:
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Services.
• Our total liability to you for any claim shall not exceed the amount you paid us for the specific order or service giving rise to the claim.
• We are not responsible for the acts or omissions of third-party delivery services, payment processors, or online ordering platforms.
8. Indemnification
You agree to indemnify, defend, and hold harmless Yan's Gourmet, its owners, employees, agents, and affiliates from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of [Insert State – e.g., California], without regard to conflict of law principles. Any disputes arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in
San Diego County, City of San Diego, CA.
10. Changes to Terms
